What an attorney receives is a report that checks every CPT and HCPCS code against the medical record, flags upcoding, unbundling and modifier errors where they exist, and prices every line against a published benchmark for that code, in that locality, on that date of service, with the arithmetic shown so the other side's own expert can check it line by line. Where a state sets the standard by statute, the report applies it: Texas section 41.0105's "paid or incurred" cap, Florida section 768.0427, and Georgia's 2025 medical damages reform. He is available to sign a Texas section 18.001 counteraffidavit. Have you done this before? The Texas Supreme Court has held that a counteraffiant need not be a physician, and that a reviewer who compares billed CPT codes to the medical records and prices them against a national charge database may sign one (In re Allstate Indemnity Co., 2021). That is his review method. He has not previously been deposed or testified at trial. It is stated here rather than left for opposing counsel to find. Every opinion he signs is built to be checked against the published benchmark it came from. He does not give an opinion on whether a treatment was medically necessary or whether care met the standard of care. His opinion is limited to whether the code billed matches the service documented, and whether the charge is reasonable against the published benchmark.
